General
These conditions of Sale apply to the supply of products and services by Airlift (the seller) to you (the buyer) and your order will be accepted on the basis of these conditions and the IMPORTANT NOTES which accompanied our quotation. Any variation to these conditions will not apply unless agreed in writing by a Director of Airlift.
Performance
It is the responsibility of the buyer to satisfy himself as to the fitness and suitability of the goods for their particular purpose and application
Liability
Airlift shall not be liable for loss of profit, damage, expense or for any accident incurred on goods or services supplied or any consequential loss, damage or expense sustained by the buyer by breach of contract by the seller or the buyer’s failure to act appropriately to the notice given in paragraph No. 2 above. Nor shall we be responsible for damage caused by or arising from or attributable to the use of the goods or services supplied.
Price
The prices quoted are net of any discounts etc., and remain in force for a period of 30 days unless otherwise specified. Carriage, shipping, freight, insurance and packaging charges will be charged as applicable.
Value added tax or any other relevant sales tax, export tax, import tax, duties and any similar taxes and charges will be added at the rate applicable at the time of delivery.
Delivery
Airlift will endeavour to meet all delivery and/or installation schedules, but cannot accept any responsibility for failure to do so.
Payment
Payment terms will be as set out in Airlift official quotation, offer letter or other written agreement.
Claims and Disputes
Supply of Goods only: The buyer shall accept all goods at time of delivery and any notice of claim for damage or shortage must be notified to Airlift within three working days. This is pneumatic and/or Airbag powered apparatus and it is the buyer’s responsibility to handle and store the goods in an appropriate manner to prevent loss or damage.
Supply and Installation (carried out by Airlift): It is the responsibility of the buyer to store the goods in such a way as to prevent loss or damage if delivered to site or the buyer’s premises prior to installation by the seller’s contractors.
Any dispute arising from the installation of the goods must be notified in writing within ten working days.
Installation and Commissioning
A commissioning certificate will be issued upon:
a) A satisfactory completion of the installation by Airlift. OR
A satisfactory inspection by Airlift of the installation carried out by others.
Additional Works
Airlift reserve the right to further charge for any additional works or costs incurred as a result of an incorrect installation by others or by subsequent damage to the installation caused by others in the period prior to final commissioning.
Title
The title of the goods shall remain with Airlift until such time as payment in full has been received. The seller reserves the irrevocable authority to recover equipment if payment is not received according to the stated terms in Airlift official quotation, offer letter or other written agreement.
Interruption of Work (If pertaining to installation contracts being carried out by Airlift)
a) Where our agreed schedule for installation is interrupted or frustrated, Airlift reserve the right to levy an additional charge to cover time on site, travelling, any subsistence and transport costs as applicable.
b) Re-Scheduling of Deliveries or Works. A minimum of 48 hours notice must be given otherwise charges may be levied to cover any costs incurred.
Cancellation of Order (If pertaining to installation contracts being carried out by Airlift)
Airlift reserve the right to charge the full cost of all materials and the value of all work done to fulfil the contract up to the date of cancellation.
